Terms of Use

These Terms of Use (“Terms”) govern your access to and use of FeelMeTV, operated by Wiser5 LLC (“Company,” “we,” “us,” or “our”) at wiser5.com/feeltv (the “Service”). By using FeelMeTV, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

FeelMeTV provides mood-based TV show recommendations. You answer a short quiz about how you want to feel and content you wish to avoid. We return ranked show suggestions with match scores and explanations. FeelMeTV is currently offered as an MVP and may change, pause, or discontinue features at any time.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use FeelMeTV. If you use FeelMeTV on behalf of an organization, you represent that you have authority to bind that organization.

3. No Account Required

The MVP does not require account registration. We may store a random session identifier in your browser for feedback and analytics. You are responsible for activity associated with your device and browser storage.

4. Acceptable Use

You agree not to:

  • Use the Service for unlawful, harmful, or fraudulent purposes
  • Attempt to scrape, overload, reverse engineer, or disrupt the Service or its APIs beyond normal interactive use
  • Bypass rate limits, admin authentication, or security controls
  • Submit malware, automated spam, or abusive traffic
  • Misrepresent your identity or affiliation when contacting support
  • Use FeelMeTV recommendations as professional medical, legal, or safety advice

We may suspend or block access for abuse or risk to the Service.

5. Recommendations Are Informational

Recommendations are algorithmic suggestions based on available metadata and emotional profiles. They are not guarantees of enjoyment, availability on any streaming service, age-appropriateness for your household, or completeness of content warnings. Always use your own judgment. Content warning labels may be incomplete, outdated, or incorrect.

6. Third-Party Data and Links

Show information may come from third parties such as TMDB. Posters, descriptions, and ratings belong to their respective owners and are used under applicable licenses and terms. FeelMeTV may link to third-party websites. We do not control and are not responsible for third-party content, availability, or policies.

7. Intellectual Property

The FeelMeTV name, branding, software, recommendation engine, emotional profiles we create, and site design are owned by Wiser5 LLC or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not copy, redistribute, or commercially exploit our emotional profile dataset or APIs without written permission.

Third-party show titles, artwork, and trademarks remain the property of their owners. No endorsement by TMDB or any studio is implied.

8. Feedback

If you submit feedback (including thumbs-up/down or suggestions), you grant Wiser5 LLC a worldwide, royalty-free license to use that feedback to operate and improve the Service. Do not submit confidential information you do not want us to use.

9. Privacy

Our Privacy Policy explains how we collect and use information. By using FeelMeTV, you also agree to that Policy.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RECOMMENDATIONS WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISER5 LLC AND ITS FOUNDERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF FEELTV. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US FOR FEELTV IN THE PRIOR TWELVE MONTHS (IF ANY), WHICHEVER IS GREATER.

12. Indemnity

You agree to indemnify and hold harmless Wiser5 LLC from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or violation of these Terms.

13. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Updated Terms will be posted on this page with a new effective date. Continued use after changes constitutes acceptance. If you do not agree, stop using FeelMeTV.

14. Termination

You may stop using FeelMeTV at any time. We may suspend or terminate access immediately if you violate these Terms or if we discontinue the Service.

15. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, unless mandatory consumer protections in your jurisdiction provide otherwise. Courts located in Florida shall have exclusive jurisdiction, subject to applicable consumer rights.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms and the Privacy Policy are the entire agreement regarding FeelMeTV. Our failure to enforce a provision is not a waiver.
